Terms of Service

Last updated: 2026-05-12 Effective: upon account creation or first paid subscription, whichever is earlier.

These Terms of Service (the "Terms") form a binding contract between you (the "User", "you") and SafeASIN ("we", "us", "SafeASIN") governing your use of the SafeASIN web application, browser extension, APIs, and any related services (collectively, the "Service").

By creating an account, clicking "I agree", or using the Service, you confirm you have read, understood, and accept these Terms.


1. Who can use SafeASIN

1.1 You must be at least 18 years old and able to form a binding contract.

1.2 The Service is intended for professional sellers doing business on Amazon US (and adjacent marketplaces). It is not intended for consumers, not intended for end-buyers of children's products, and not intended for users under 13.

1.3 By signing up, you confirm that you are acting on behalf of a legitimate business and that your use complies with the policies of the marketplaces you sell on (including, where applicable, Amazon's Business Solutions Agreement).


2. What SafeASIN is — and is not

2.1 SafeASIN is a software tool that:

  • (a) reads publicly available product listing data, public consumer reviews, and public regulatory recall notices;
  • (b) applies keyword matching and AI-assisted analysis to flag potential compliance risks;
  • (c) generates draft text (such as appeal drafts, listing rewrite suggestions) for your review and use.

2.2 SafeASIN is not:

  • (a) a law firm. We do not provide legal advice, attorney-client representation, or formal legal opinions. Nothing in the Service creates an attorney-client relationship.
  • (b) an Amazon partner, agent, reseller, or affiliate. We are not endorsed by, sponsored by, or affiliated with Amazon.com, Inc. or any of its subsidiaries.
  • (c) an agent of the U.S. Consumer Product Safety Commission (CPSC), the U.S. Food and Drug Administration (FDA), ASTM International, the International Organization for Standardization (ISO), or any other regulatory or standards body. We are independent and not endorsed by any agency we cite.
  • (d) a compliance certification, testing laboratory, or accreditation body.
  • (e) a substitute for licensed counsel, a qualified compliance consultant, or a Children's Product Certificate (CPC) issuer.

2.3 AI outputs are drafts only. All AI-generated text (including but not limited to appeal drafts, listing rewrite suggestions, risk assessments, and readiness checklists) is provided as a starting point for your own review. You — and only you — are responsible for what you submit to Amazon, regulators, or third parties.


3. Your account

3.1 You agree to keep your login credentials confidential and to notify us immediately at the contact email if you suspect unauthorized access.

3.2 You are responsible for all activity under your account.

3.3 We may suspend or terminate accounts that violate these Terms, engage in fraud or chargeback abuse, or pose a security risk.


4. Acceptable use

You agree not to:

4.1 Reverse-engineer, decompile, or attempt to extract source code from the Service (except to the extent expressly permitted by applicable law).

4.2 Use the Service to scrape Amazon, CPSC, FDA, or any third party at a rate, volume, or in a manner that would violate that party's terms of service or technical access controls.

4.3 Submit AI-generated drafts produced by the Service without human review to Amazon, the CPSC, the FDA, customs authorities, or any other regulator. You agree that every draft is reviewed and edited by a human (you, your team, or your counsel) before submission.

4.4 Use the Service to engage in misleading product positioning, false advertising, evasion of safety standards, or any unlawful conduct.

4.5 Resell, sublicense, or white-label the Service without a written agreement signed by both parties.

4.6 Use the Service to harass, defame, or harm other sellers.


5. Subscription, billing, and cancellation

5.1 SafeASIN offers a free tier and one or more paid subscription tiers. Pricing is shown on the public pricing page and may change with 30 days' notice; existing subscriptions are honored at the rate in effect when they started for the remainder of the current term.

5.2 Paid subscriptions renew automatically at the end of each billing cycle unless canceled. You can cancel at any time from the Stripe Customer Portal; cancellation takes effect at the end of the current paid period.

5.3 Refunds: see the Refund Policy. In short — we offer prorated refunds within 14 days of the first paid charge if you have not used the service heavily, and no refund for partial months otherwise. Subscription cancellation mechanics and Stripe billing are governed by this section; refund eligibility, timelines, usage thresholds, and abuse conditions are governed by the Refund Policy. If a single sentence appears in both documents and they disagree, the more specific sentence controls.

5.4 We do not charge cancellation fees. Downgrades may forfeit any plan-specific allowances (e.g. higher ASIN monitor counts) at the next billing cycle.

5.5 You authorize us, through our payment processor (Stripe), to charge your payment method for all amounts owed. You agree to keep your billing information accurate.


6. Beta features and invite-only access

6.1 SafeASIN is currently in closed beta. Access is invite-only.

6.2 Beta features may change, break, or be removed without notice. Beta output may be inaccurate, incomplete, or formatted inconsistently. We mark experimental features clearly inside the Service.

6.3 Beta promotional benefits (including, where offered, complimentary Guard-tier access for up to twelve (12) calendar months for qualifying invitees) apply only to invitees who sign up during the active beta window and continue to use the Service without abuse. After the promotional period ends we will notify you by email at least 14 days before the first paid charge, and you may cancel at any time before that date at no cost; if you do not cancel, the subscription will auto-renew at the then-current published price. We reserve the right to modify or revoke beta promotional benefits at any time if we detect fraud, chargeback abuse, multiple-account abuse, or a material breach of Section 4.


7. Intellectual property

7.1 The Service, including its software, design, copy, prompts, risk keyword corpus, and proprietary algorithms, is owned by SafeASIN or our licensors and protected by U.S. and international IP law.

7.2 You retain ownership of all listings, ASINs, content, and account information you submit ("Your Content"). You grant SafeASIN a limited, non-exclusive, royalty-free license to use Your Content solely to operate, maintain, and improve the Service for you, in accordance with the Privacy Policy.

7.3 AI-generated drafts based on Your Content are made available to you without claim of authorship by SafeASIN. You may use them as you wish, subject to your obligations under section 4.3.

7.4 Public regulatory data (CPSC recall notices, FDA enforcement actions, ASTM/ISO standard numbers) is sourced from official government and standards-body endpoints. SafeASIN does not claim ownership over public regulatory data and links to the official source on every report.


8. Disclaimers — please read carefully

8.1 THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

8.2 WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT IT WILL DETECT EVERY APPLICABLE RECALL, RISK, REGULATION, OR LIABILITY. Marketplace data and regulatory feeds change continuously and may be incomplete or out of date at any given moment.

8.3 AI OUTPUT MAY BE INCORRECT. Large language models can produce content that is plausible-sounding but factually wrong. You agree to treat all AI output as a draft requiring human review before use.

8.4 NO GUARANTEE OF AMAZON REINSTATEMENT. Use of the Service — including any appeal draft generated by the Service — does not guarantee that Amazon will reinstate a listing, account, or ASIN. Amazon makes all final decisions about its marketplace.

8.5 NO GUARANTEE OF COMPLIANCE. SafeASIN cannot certify your product as compliant with the CPSIA, CPSC, FDA, ASTM, ISO, or any other regulation. Compliance certification requires accredited testing labs and qualified counsel. The Service is a screening and drafting aid only.


9. Limitation of liability — please read carefully

9.1 EXCLUDED DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL SAFEASIN, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, DATA, BUSINESS OPPORTUNITY, INVENTORY, ACCOUNT REINSTATEMENT, OR REGULATORY APPROVAL, EVEN IF WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9.2 AGGREGATE CAP. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL CUMULATIVE LIABILITY UNDER THESE TERMS WILL NOT EXCEED THE GREATER OF:

  • (a) the amount you actually paid SafeASIN in the twelve (12) months immediately preceding the event giving rise to the claim; or
  • (b) one hundred United States Dollars (USD $100).

9.3 AMAZON / REGULATOR DECISIONS. SafeASIN is not liable for any decision made by Amazon, the CPSC, the FDA, U.S. Customs and Border Protection, or any other regulator regarding your listings, your account, your imports, or your products.

9.4 JURISDICTION CARVE-OUTS. Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. In those jurisdictions, the limitations above apply only to the maximum extent permitted by applicable law.


10. Indemnification

You agree to defend, indemnify, and hold SafeASIN harmless from any third-party claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of:

  • (a) Your Content;
  • (b) your submission of AI drafts without human review (a violation of section 4.3);
  • (c) your violation of these Terms; or
  • (d) your violation of applicable law or the rights of a third party.

11. Service availability, third-party dependencies, and failure modes

11.1 No SLA during beta. We will use commercially reasonable efforts to keep the Service available, but we do not commit to a specific uptime SLA during the closed beta period. Once a public general- availability tier ships, the applicable SLA will be linked from this section.

11.2 Third-party data sources. The Service depends on independent third parties (including, without limitation, Amazon listing data via DataForSEO, U.S. CPSC saferproducts.gov and recalls feeds, U.S. FDA public feeds, Stripe, Supabase, Resend, OpenAI, and other AI providers). These sources may be unavailable, delayed, incomplete, or contain errors outside our control. We are not liable for:

  • (a) data that is missing, stale, or incorrect because a third-party source returned an error, returned no data, or was rate-limited;
  • (b) audit results that are partial because an upstream provider failed (we will mark such results as "partial" where reasonably possible);
  • (c) recall information that is published by a regulator but did not reach our system in time for an audit to surface it.

11.3 Notifications are best-effort. Email alerts, recall push notifications, and in-app banners are best-effort delivery through third-party email infrastructure (Resend). We do not guarantee delivery, inbox placement, or timing. You must not rely on our notifications as your only or primary monitoring channel for product safety, regulatory recalls, or account status. If you require guaranteed notice for legal or compliance reasons, you must subscribe directly to the relevant regulator (e.g. CPSC.gov, FDA recall feeds) and maintain your own monitoring.

11.4 Data freshness disclosure. Where reasonably possible, the Service displays a "last synced" timestamp next to data fetched from external sources. The absence of a fresh timestamp does not extend any warranty; data may be stale even when the timestamp is recent.

11.5 Service modifications. We may modify, suspend, or discontinue all or part of the Service at any time. For paid users, if we permanently discontinue the Service during your paid period, we will refund the prorated unused portion of your subscription.

11.6 Planned maintenance. Where reasonably possible, we will announce planned maintenance via email and/or our status page (when available) at least 24 hours in advance. Emergency maintenance may occur without notice.

11.7 Updates to these Terms. We may update these Terms from time to time. Material changes will be announced via email at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.


12. Failure response and user remedies

12.1 What happens when something goes wrong. Despite our best efforts, individual audits may fail, emails may not be delivered, payment events may be delayed, and the Service may experience incidents. This section describes what you can expect and what remedies are available.

12.2 Audit failures.

  • If an audit cannot complete because an upstream provider failed, we will surface the error in the UI with a recognizable error code.
  • If the failed audit consumed plan quota or usage credits and we can determine the failure programmatically, we will attempt to restore the credit automatically. If we cannot, email support@safeasin.com with the audit ID and we will restore credits or make a manual adjustment after verification, typically within five (5) business days.
  • We may use cached or partial data and clearly mark it as such.

12.3 Email delivery failures.

  • We treat all transactional email as best-effort (see Section 11.3). If a billing email, password reset email, or recall alert email fails to deliver, we may retry, log the failure for our records, and where feasible reflect the failure inside the application on your next sign-in.
  • You must keep the email address on your account current and valid. If you stop receiving expected emails (billing receipts, security notices, recall alerts), check your spam folder, verify your address in Settings, and contact support@safeasin.com if the problem persists.

12.4 Payment and billing incidents.

  • If Stripe sends the same webhook event more than once, we evaluate duplicate deliveries against Stripe's event identifiers and our internal logs. If you believe you were charged twice for the same subscription period, email support@safeasin.com within thirty (30) days; after we verify the duplicate against Stripe's authoritative records, we will refund the confirmed duplicate amount in full.
  • If your payment method fails (e.g. card declined), Stripe dunning will retry per Stripe defaults. If all retries fail, the subscription is canceled, the account drops back to the Free tier (data preserved), and we will email you to update payment so you can re-activate at any time. Detailed dunning behavior is in the Refund Policy section 8.
  • Refund eligibility and abuse thresholds are governed by the Refund Policy.

12.5 Security incidents. In the event of a confirmed personal data breach as defined under applicable law, we will notify affected users within seventy-two (72) hours of confirmation, consistent with GDPR Article 33 timelines, with the information available at that time and a follow-up post-mortem.

12.6 Status reporting. Our public status page at /status is the canonical source of current incident state and recent component health (web app, recall sync, review sync, ASIN matcher). Ongoing incidents may additionally be communicated via email to affected accounts and via in-app banners. Publication on /status does not constitute a service-level commitment — see § 8 (Disclaimers) and § 9 (Limitation of Liability).


13. Termination

13.1 You may terminate your account at any time from Settings.

13.2 We may suspend or terminate your account immediately for material breach of these Terms, suspected fraud, abusive behavior, or as required by law.

13.3 Sections 7, 8, 9, 10, 11, 12, 14, and 15 survive termination.


14. Governing law and dispute resolution

14.1 These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles.

14.2 Informal resolution first. Before filing a formal claim, you agree to contact us at support@safeasin.com and try in good faith to resolve the dispute for at least 30 days.

14.3 If informal resolution fails, any dispute will be resolved in the state or federal courts located in New Castle County, Delaware, and both parties consent to the personal jurisdiction of those courts.

14.4 No class actions. To the maximum extent permitted by law, you agree to bring any claim only in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.


15. Miscellaneous

15.1 Entire agreement. These Terms, together with the Privacy Policy and the Refund Policy, are the entire agreement between you and SafeASIN regarding the Service.

15.2 No waiver. Our failure to enforce a provision is not a waiver.

15.3 Severability. If any provision is unenforceable, the rest remains in force.

15.4 Assignment. You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
